Donald Trump, the twice-divorced president-defect has once again demonstrated how unprepared he and his entire team are to take office by appointing retired general James “Mad Dog” Mattis, as his pick for Secretary of Defense. It’s ILLEGAL!
This position is one of the very few cabinet positions actually identified in the Constitution, so important is it to the foundations of our government. Originally known as the Secretary of War, one of the key tenants of this position, and indeed the president’s role himself is the civilian oversight of the military. Congress has even passed a law that makes it illegal for this role to be filled by anyone who has been in the military less than seven years ago.
Only once in the entire history of the United States has this law been excepted and Congress had to pass a resolution to do that. And even more imortant, in that law, they said that Congress should NEVER do that again. When the made their only exception in 1950, the said in plain language that it should never happen again.
“It is hereby expressed as the intent of the Congress that the authority granted by this Act is not to be construed as approval by the Congress of continuing appointments of military men to the office of Secretary of Defense in the future…It is hereby expressed as the sense of the Congress that after General Marshall leaves the office of secretary of defense, no additional appointments of military men to that office shall be approved.”
And if you had any doubts about Donald Trump’s intentions on the international stage, think about what it means to appoint someone named “Mad Dog” to lead the Military. In a move reminiscent of dictators throughout history, this is a move to bend the military might of our nation to his will, not the will of the people.
